“RESTRICTING THE MOVEMENT OF UNVACCINATED INDIVIDUALS IN THE MUNICIPALITY OF SAN NICOLAS, PANGASINAN”

WHEREAS, the Philippine Government recognizes the huge national endeavour that the country needs to undertake in ensuring equal access to vaccines and quality vaccination services;

WHEREAS, the COVID-19 vaccine deployment and vaccination program is an endeavour necessitating the participation of all members of the society where each member has a vital responsibility to uphold and role to play;

WHEREAS, the Philippine government recognizes the vitality of adapting newer knowledge and scientific evidence gathered through research and innovation on COVID 19 vaccine and immunization to ensure effective implementation of COVID-19 immunization services;

WHEREAS, the Department of the Interior and Local Government (DILG) Memorandum Circular No. 2020-023 recognizes the lead role of local government units (LGUs) in the prevention, mitigation, preparedness for, and containment of the Coronavirus Disease 2019 (COVID 19) outbreak at the local level;

WHEREAS, DILG Memorandum Circular No. 2022-002 directs all Local Government Unit to restrict the movement of unvaccinated persons;

NOW, THEREFORE, I, DR. ALICIA L. PRIMICIAS-ENRIQUEZ, Local Chief Executive of the Municipality of San Nicolas, Pangasinan, by virtue of the power vested in me by law, do hereby order:

Section 1. MANDATORY MAPPING OF ALL UNVACCINATED INDIVIDUALS IN BARANGAYS:

1. All Punong Barangays are hereby enjoined to:

a. Prepare a monthly inventory of vaccinated population in the barangay indicating their status, whether with first dose only, fully vaccinated (with two doses), or with booster dose already (see attached template provided by DILG MC 2022-002).

b. Accomplished monthly inventory form shall be in the custody of the barangay for monitoring purposes. Copy of which shall be submitted to the Office of the Municipal Mayor, Municipal Health Officer and DILG Field Officer for consolidation not later than the 10th day of the ensuing month.

Section 2. RESTRICTION ON NON-FULLY VACCINATED INDIVIDUALS. All Non-Fully Vaccinated Individuals shall:

a. Remain in their residences at all times except for the procurement of essential goods and services, provided, however, that the individual outdoor exercise shall be allowed within the general area of their residence, e.g., within the barangay or purok.

b. Be prohibited in indoor and outdoor/al fresco dining in restaurants and other food establishments and shall likewise be prohibited from leisure or social trips to malls, hotels, event venues, and other similar facilities.

c. Be prohibited in public transportation except for the procurement of essential goods and services subject to the production of proof to support and justify such travel.

d. Be prohibited in entering government offices, public market, recreational parks, religious establishments, and other similar public areas.

e. Unvaccinated individuals employed in the Municipality of San Nicolas, public or private, shall be required to undergo a Reverse Transcription – Polymerase Chain Reaction (RT-PCR) test every two (2) weeks at their personal expense and present a COVID-19 negative result prior to being admitted for work onsite subject to issuances of the IATF and DOLE, provided, however, that in the event the RT-PCR test and/or result is/are not immediately available, a Rapid Antigen Test may be utilized in lieu thereof; and provided, further, that the employer shall have the option to provide a non-fully vaccinated employee a grace period of one (1) calendar month to obtain his or her first COVID-19 vaccination shot. As long as the employee obtains the first shot within the grace period, and subsequently obtains any required second shot as prescribed for the concerned vaccine, the employee shall not be required to take the biweekly test or otherwise be held liable under this clause.

The foregoing rules shall also cover individuals who reside outside the municipality but who work and/or travel to the same.

Likewise, the foregoing rules shall be implemented in the event of Alert Level 3 or above or its equivalent.

Section 3. PRESENTATION OF VACCINATION ID. It shall be the responsibility of every establishment mentioned in Section 2 hereof to require the presentation of vaccination ID before allowing entry thereof.

Only VACCINATION ID WITH QR CODE shall be recognized as valid for the residents of this municipality. For residents outside the municipality, presentation of valid ID and vaccination card shall likewise be required.

Further, any individual and establishment who or which will falsify the COVID 19 vaccine card/ID will be prosecuted under Municipal Ordinance No. 120 s. 2021, “Prohibiting Tampering, Forging, Altering or Reproducing Without Authority of, Authentic COVID-19 Vaccination Cards as well as Those Who Present the Same and Providing Penalties for Violation Thereof”, without prejudice to prosecution under other applicable laws.

Section 4. REPEALING CLAUSE. Previous issuance or any portion thereof, which are inconsistent with the provision of this Executive Order are hereby amended, modified, superseded or repealed accordingly.

Section 5. SEPARABILITY CLAUSE. If any section or provision of this Executive Order is declared void, ineffective or invalid by a court of competent jurisdiction, the holding of such section or provision to be void or invalid for any cause whatsoever shall in no way affect the validity of the remaining sections and provisions, which shall remain in full force and effect.

Section 6. EFFECTIVITY CLAUSE. This Executive Order shall take effect immediately upon the date hereof and shall remain in effect until rescinded, repealed or amended.
