Mandate and Functions

The Sangguniang Bayan of San Nicolas, Pangasinan, as legislative body of the municipality, is composed of the Municipal Vice Mayor as the Presiding Officer, eight regular Sangguniang Members, the President of the municipal chapter of the Liga ng mga Barangay, Sangguniang Kabataan Federation President and Indigenous People Mandatory Representative. The term of office of the members of the Sangguniang Bayan of San Nicolas shall be determined by law, which shall commence and end such dates as may be provided by the same. All members of the Sangguniang Bayan upon assumption of office took an oath of office or affirmation in a prescribed form, duly subscribed before a person authorized to administer the oath.

The Municipal Vice Mayor being the Presiding Officer exercises powers and duties as provided by law, ordinance and regulations.

The Regular Session of the Sangguniang Bayan is held every Monday promptly and begins at 9:00 o’clock in the morning. However, that day falls on a holiday, session is prevented by insuperable cause, the next working day shall be a regular session day.

Upon a day’s prior notice, a Special Session may be called by the Municipal Vice Mayor or by a majority of all members of the Sanggunian. Provided, that no more than two (2) sessions shall be held in a single day.

The meetings and sessions of the Sanggunian are held in the Session Hall. Subject to agreement between the Municipal Vice Mayor and a majority of the members, particular session may be held elsewhere within the Municipality of San Nicolas.

Session or meeting of the Sangguniang Bayan is open to the public unless a closed door session is decided or ordered by an affirmative vote of the majority of the members present, there being a quorum, for public interest for reasons of secrecy, decency, or morality.

The Sangguniang Bayan Office Staff is composed of the Secretary to the Sangguniang Bayan, two (2) Local Legislative Staff Assistant II and an Administrative Aide(s) who are ever ready and prompt in the delivery of frontline services of the office.

OBJECTIVE

Effectively steer the Sangguniang Bayan Members (SBM) to actively and productively  participate in all legislative actions, processes, and decision making in accordance  with generally  accepted  Parliamentary Rules and adherence to the approved  Internal Rules of Procedure with the end view of enacting measures and ordinances as mandated under Section  458 of RA 7160 otherwise known as the Local  Government Code  of 1991, and in consonance with the Social Contract with the Filipino People of the National Government and with the Executive and Legislative Agenda (ELA) of the Municipality of San Nicolas.

FUNCTIONAL STATEMENT

  • Be the Presiding Officer of the Sangguniang Bayan and sign warrants drawn on the Municipal Treasury for all expenditures appropriated for the operation of the Sangguniang Bayan.
  • Subject to Civil Service Law, rules and regulations, appoint officials and employees of the Sangguniang Bayan except those whose manner of appointment is specifically provided in the code;
  • Assumes the office of the Municipal Mayor for the unexpired term for the latter in the event of permanent vacancy provided for in Section 44 of the Local Government Code;
  • Exercise powers and performs the duties and functions of the Municipal Mayor in case of temporary vacancy as provided for in Section 46 of the Local Government code; and
  • Exercise such other powers and performs such other duties and function as may be prescribe by law or ordinances.
